Rubbish truck driver sentenced after running over four-year-old

A rubbish truck driver in Perth has been fined $2500 and banned from getting behind the wheel for three months after a boy was run over in Scarborough.

The sentencing wasn't enough for the boy's dad, John Fogarty.

"My son's been recovering for longer than that," Fogarty told 9News outside court today.

Jackson Fogarty is still undergoing rehabilitation after his leg was broken, his neck injured and the youngster was left traumatised by the accident.

The four-year-old was scooting along Deanmore Road in November when he was run over by the rubbish truck leaving a laneway.

A magistrate ruled the incident was horrifying and distressing, but ultimately an accident.

"He's going to have to look at himself every day knowing that's what he's done," Fogarty said of the driver.

Fogarty is now considering legal action against the waste company, Veolia, which says it takes road safety seriously.

The father is also waging another war against Stirling Council.

"It runs directly next to a primary school. It's a dirt laneway, it's common sense to create an environment for this to not happen again," he said.
