The teenager accused of being behind the wheel of a stolen BMW when it hit and killed a 19-year-old motorcyclist in Melbourne has been granted bail.

Davide Pollina’s family has expressed their dismay, just days after parliament voted to strengthen bail laws and crack down on young offenders.

One week on from the deadly hit-run police arrested a 16-year-old boy at a home in Melbourne’s north-east.

They allege he was behind the wheel of the stolen BMW when it slammed into Pollina’s motorcycle in Preston.

The teenager has been charged with eight offences including dangerous driving causing death, failing to stop at the scene of an accident and render assistance, home invasion, aggravated burglary while someone was home, theft of a motor vehicle and burglary.

His two alleged accomplices, 16 and 17, were also bailed.

It comes just three days after parliament voted to strengthen bail laws.

Premier Jacinta Allen said she’s “not going to cut across a court process”.

Opposition Leader John Pesutto said he has “no faith that the Allen government’s changes to youth justice will change anything”.

The Pollina family told 9News they’re disappointed the alleged driver was granted bail and fear he’ll re-offend.

Davide’s funeral will be held later this week.

He’ll be cremated and his ashes taken back home to Italy.

The teenager will face a children’s court next month.
